El informe presenta una visión general de la transposición por parte de los Estados miembros de la Directiva sobre la aplicación de la ley (LED). Considera que la LED garantiza un nivel armonizado y elevado de protección de los derechos de las personas y proporciona un marco jurídico coherente para el tratamiento de datos por parte de las autoridades judiciales y policiales. El informe también contiene una lista de acciones para que la Comisión, los Estados miembros, el Consejo Europeo de Protección de Datos y las autoridades de control de la protección de datos aprovechen todo el potencial de la LED.

The report examines, in particular, the application and functioning of the LED’s rules on the transfer of personal data to third countries and international organisations as required by the LED, but it also takes a broader approach. It situates the LED within the frameworks of EU law on the protection of personal data and EU law regulating the processing of personal data for the purposes of prevention, investigation, detection or prosecution of criminal offences and the execution of criminal penalties, including safeguarding against and prevention of threats to public security (‘criminal law enforcement’)2. The report provides an overview of the Member States’ transposition of the LED into their national laws, presents the first lessons drawn from the LED’s application and functioning, and outlines the way forward.
